Terms and Conditions of Sale – Evocircle
Scope of Application
These conditions apply to all orders placed on the website evocircle.eu by private customers or professionals with a VAT number. By ordering, the customer fully accepts the terms and conditions in force at the time of purchase.
Before purchasing, the customer receives all mandatory information (product features, price, payment and delivery methods, right of withdrawal, legal warranty). Some products may require the Manage-Mii app, Curve, and NFC-enabled devices.
Subject Matter
The contract concerns the remote sale of products available on the website, concluded in the Italian language. A copy of the Terms and Conditions will be sent via email to the customer.
Use of the Website
The website must be used lawfully. Evocircle reserves the right to suspend access in the event of illegal or suspicious use.
Purchase Procedure
Purchases can be made as a guest or with a registered account. The provided information must be correct and up to date. Data is processed in accordance with the Privacy Policy.
The order is a purchase proposal and becomes binding only when confirmed via email by Evocircle. The confirmation includes all order details and a link to the Terms and Conditions. The contract is considered void in the case of non-payment.
Prices
All prices are in euros, including VAT and shipping. Evocircle may update prices, but the order will be charged based on the price in effect at the time of purchase. In case of an obvious pricing error, the order will be canceled and refunded. If requested, an invoice can be issued, provided the correct billing information is supplied during checkout.
Payment Methods
Payment can be made via credit/debit card (Visa, Mastercard, American Express, Maestro), PayPal, Google Pay, Apple Pay, or Gift Cards.
If payment fails, the order will be canceled. Card data is protected, and Evocircle does not store card information. Refunds will be processed using the same payment method. Strong customer authentication may be required for security.
Product Availability
Available products are those shown on the site at the time of order. Images are indicative and may differ from the actual product.
Availability may change due to simultaneous sales or technical issues. If a product becomes unavailable after ordering, Evocircle will notify the customer by email and refund any paid amount.
For orders with multiple items, only the unavailable items will be excluded; the rest will be shipped as scheduled.
Shipping and Delivery
Shipping is available throughout Italy, excluding San Marino and Vatican City. All orders are fulfilled within 7 days of confirmation, and shipping is always free.
Once your order is ready, you will receive an email with a tracking link. If the courier fails to deliver due to the recipient’s absence, another attempt will be made. After additional failed attempts, the order will be held in storage, and extra fees may apply.
Please check the package immediately upon delivery. If you notice any issues, you may accept the delivery with a motivated reservation, such as:

Photos should be taken, and a report should be sent to us within 24 hours.
Evocircle is not responsible for delays, service disruptions, or delivery failures due to extraordinary events such as strikes, emergencies, technical failures, or network problems.
We are also not responsible for errors caused by incorrect information provided by the customer (e.g., wrong shipping address).
Right of Withdrawal and Returns
You may cancel your purchase within 14 days of receiving the product, without the need to provide any reason.
This right does not apply to purchases made by businesses or professionals with a VAT number.
To initiate the withdrawal, send an email to info@fares.it, stating your intention and including order details. The product must be returned within 14 days, complete and in its original packaging.
Once the return is received and verified, a refund will be issued within 14 days using the original payment method.
If a Gift Card was used, the refunded amount will be credited back to the same card.
Returns that do not meet the conditions (e.g., missing accessories, damaged or tampered items) will be rejected and returned to the sender, with any shipping costs charged to the customer.
Product Warranty
All products sold on our website are covered by a Legal Warranty of Conformity, valid for 24 months from the date of delivery for private customers.
The warranty covers defects that make the product unusable or not as described.
Customers may request repair, replacement, partial, or full refund, depending on the case.
Damage caused by misuse, accidents, or unauthorized modifications is not covered.

For purchases made with a VAT number, the warranties provided by the Civil Code apply, requiring defects to be reported within 8 days of discovery and within 6 months of delivery.
Gift Cards
Gift Cards, whether digital or physical, can only be used for purchases on our website. They cannot be used to purchase other gift cards.
Each card is valid for 12 months from the date of issuance.
Multiple gift cards can be used in the same order, including during promotions.
If the gift card balance is insufficient, the remaining amount can be paid using other accepted payment methods.
Gift card value is non-refundable and non-exchangeable for cash.
In case of misuse or suspected fraud, we reserve the right to cancel the gift card.
Limitation of Liability and Indemnification
Unless otherwise expressly agreed, Evocircle’s liability for damages arising from contract performance is excluded, limited, or reduced within the bounds of applicable law.
Indemnification Obligation
The CUSTOMER agrees to indemnify and hold harmless Evocircle, its collaborators, affiliates, representatives, partners, and employees from any claims, costs, or demands – including legal fees – made by third parties due to the CUSTOMER’s violation of these terms, third-party rights, or applicable laws.
This also applies to claims made by Evocircle’s clients regarding the conformity of digital products provided.
Liability for Website Use by the Customer
Except where otherwise provided or where mandatory legal obligations apply, Evocircle shall not be held liable for damages resulting from use of the website.
This does not affect non-excludable liabilities by law, such as those related to personal injury, life, health, or intentional or grossly negligent breaches of essential contractual obligations.
In all other cases, any compensation shall be limited to foreseeable and typical damages for this type of contract.
Website Use
The CUSTOMER may access the website solely for browsing and purchasing purposes. Any commercial use of its content is prohibited.
All elements on the site—graphic, textual, audio, and technological—remain the exclusive property of Evocircle and are protected by copyright laws.
Any copying, sharing, modification, translation, transmission, sale, or creation of derivative works is prohibited unless expressly permitted.
Where specified, certain content may be downloaded and used for personal purposes only, always citing the source and respecting any conditions set by Evocircle.
Links to External Resources
The website may contain links to third-party services or content. Evocircle has no control over such resources and is not responsible for their content or availability.
The applicable terms for those resources are determined by the third-party providers or, in their absence, by law.
Evocircle is not involved in or responsible for purchases or services offered by third parties linked to the website.
Personal Data Processing
The CUSTOMER’s personal data is processed according to the Privacy Policy available on the website.
Use of Cookies
The website uses cookies to enhance browsing experience, storing data such as visited pages or access times.
You can disable cookies through your browser settings, though this may limit some features, including online purchases.

Contract Assignment
Evocircle may transfer or assign its rights and obligations under these terms, while safeguarding the CUSTOMER’s interests.
The CUSTOMER may not transfer their rights and obligations without written authorization from Evocircle.
Severability Clause
These terms constitute the full agreement between the parties. If any clause is deemed invalid, the remaining provisions shall remain fully effective.

Applicable Law and Jurisdiction
These conditions are governed by Italian law. Any dispute shall fall under the exclusive jurisdiction of the Court of Rome.
